These Terms of Service (hereinafter the "Terms") constitute a legally binding agreement between you (hereinafter "User," "you") and Stratedge Labs (hereinafter "Fame Game," "we," "us," "our"), governing your access to and use of the Fame Game platform, including our website, applications, and services (collectively, the "Platform").

PLEASE READ THESE TERMS CAREFULLY. BY CREATING AN ACCOUNT OR USING OUR PLATFORM, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY ALL OF THESE TERMS, INCLUDING OUR PRIVACY POLICY. If you do not agree to these Terms, you must not use the Platform.

To ensure a clear understanding, here are the terms we will use:

2. Description of Service and Role of the Platform

Fame Game is a marketplace. Our Platform acts as a technology intermediary to enable Users to (i) order personalized entertainment services (Challenges) from independent Providers, and (ii) register for competitive, skill-based tournaments when available.

Fame Game's role is strictly limited to:

• Facilitating the connection between Clients and Providers.
• Providing a secure framework for the definition, acceptance, and validation of Challenges.
• Facilitating payments via our payment partner, Stripe, including authorizations and captures based on Platform rules.
• Providing tournament registration, match reporting, and dispute tools for skill-based competitions.

Important: Fame Game is not a party to the service agreement that is formed directly between a Client and a Provider. We are neither the employer of Providers nor an agency. Providers act as independent contractors.

Clarification: Payments on Fame Game do not unlock app features, premium functionality, or access to paid digital content. Payments relate to person-to-person services (Challenges) and/or Tournament Entry Fees.

3. Eligibility and User Accounts

To use the Platform, you must be at least 18 years old or the age of legal majority in your jurisdiction.

By creating an account, you agree to:

• Provide accurate, complete, and current information.
• Maintain the security and confidentiality of your password and account.
• Assume full responsibility for all activities conducted through your account.
• Notify us immediately of any unauthorized use of your account or any other security breach.

We reserve the right to suspend or terminate any account that does not comply with these rules.

4. Challenges (Personalized Services)

A Challenge is a request for a personalized service performed by a Provider. Providers may accept or decline any Challenge at their discretion.

• Challenge Creation by the Client: The Client defines the nature of the service they wish to order. This proposal must be clear, precise, and comply with the guidelines in Section 7.
• Funding and "Boosting": The primary Client and other Clients can commit funds to the Challenge. Depending on the payment method, your card may be authorized at the time you commit funds, and captured only after the service is validated. This is not a donation or crowdfunding mechanism: it is payment for a specific, personalized service.
• Acceptance by the Provider: The acceptance of a Challenge by a Provider forms a bilateral service agreement between that Provider and the Client(s) who funded the Challenge. The Provider agrees to perform the service according to its description.
• Performance of the Service: The Provider must perform the Challenge according to its description and provide clear evidence of its completion (such as a video recording) in a visible and unambiguous manner.
• Validation and Payment: Once the Challenge is completed and evidence is provided, a validation process (automated or manual) is initiated. After validation, the payment may be captured, our Platform Fee is deducted, and the balance is transferred to the Provider's account (subject to payout onboarding and compliance).

You acknowledge that Challenges are typically performed on third-party streaming platforms (e.g., Twitch, YouTube, Kick), which are not operated by Fame Game and have their own rules. Providers remain responsible for complying with those rules.

5. Tournaments (Skill-Based)

The Platform may offer skill-based Tournaments. A Tournament may be free to enter or may require an Entry Fee. Tournament outcomes are intended to be determined by player performance under the published rules.

• Skill-based competition: Fame Game does not introduce random outcomes, odds, or “house” mechanics. We do not bet against users and we do not provide a house advantage model.
• Entry Fee is a participation fee: Paying an Entry Fee allows you to participate in a competitive event. It does not unlock digital content, premium app features, or subscriptions.
• Prize Pool redistribution: Where applicable, prize pools are redistributed among participants based on results and verification, after applicable fees and taxes, and subject to anti-cheat and dispute resolution processes.
• Eligibility and legality: Tournaments may be unavailable or void where prohibited. You are responsible for ensuring that participation is legal in your jurisdiction and that you meet any stated eligibility requirements (including age).

6. Payments, Authorizations, Fees, and Taxes

• Payment Processor: All payments are processed by our partner, Stripe. By conducting transactions on the Platform, you also agree to Stripe's terms of service.
• Authorization then capture: Your payment method may be authorized first and captured later (for example, after a Challenge is validated or when a Tournament registration becomes final). If a payment is not captured, the authorization may be released by Stripe or your bank.
• Platform Fee: Fame Game collects a Platform Fee on each successful transaction. This fee, clearly indicated before payment confirmation, compensates for our matchmaking, moderation, and secure processing services.
• Currency and Taxes: All transactions are conducted in the currency indicated on the Platform. Each User (Client or Provider) is solely responsible for reporting and paying all applicable taxes (e.g., VAT, income tax) on their transactions.
• Refunds and Disputes: Refund or void outcomes depend on the applicable flow (Challenge or Tournament), the status of the service/registration, and Stripe/issuer rules. We may void authorizations or issue refunds when a Challenge is declined/canceled/invalid, when a Tournament is canceled or a registration is invalid, or when a dispute is resolved in a user's favor (see Section 8).

Apple and Google are not sponsors of Challenges or Tournaments and are not responsible for any activity, rewards, or disputes between Users. Payments on the Platform are not made to Apple or Google.

7. Content Guidelines and Prohibited Conduct

By using the Platform, you agree not to create, propose, or perform Challenges that involve or promote:

• Any sexually explicit (NSFW), pornographic, or adult content.
• Illegal or dangerous activities, or behavior that could cause physical or psychological harm.
• Harassment, intimidation, hate speech, discrimination, or violence against individuals or groups.
• Violation of the privacy or intellectual property rights of others.
• Spam, phishing, or the distribution of malware.

You are also prohibited from:

• Attempting to circumvent our payment or moderation systems.
• Using the Platform for unauthorized commercial purposes.
• Impersonating another person or providing fraudulent information.
• Cheating, collusion, or manipulation of Tournament results.

We reserve the right to moderate, refuse, or remove any content and to suspend any account that violates these rules at our sole discretion.

8. Dispute Resolution

In the event of a disagreement regarding the proper execution of a Challenge (or the integrity of a Tournament result), the parties agree to follow this procedure:

• Attempt to resolve the dispute amicably through the Platform's communication tools.
• If no solution is found, either party may submit the dispute to the Fame Game moderation team.
• Fame Game may review available evidence (challenge description, proof uploads, match reports, etc.) and make a decision regarding the appropriate outcome (e.g., validate completion, disqualify for rule violations, void/cancel a payment authorization, issue a refund, or split funds when applicable).

Payment disputes, chargebacks, and the resolution of payment-related matters are handled exclusively by our payment processor, Stripe. By using the Platform, you agree that any such disputes will be governed by and resolved pursuant to Stripe's applicable policies and processes.

9. Intellectual Property

• Your Content: You retain all ownership rights to the content you create (challenge texts, videos, etc.).
• License Granted to Fame Game: You grant us a worldwide, non-exclusive, royalty-free, transferable license to use, host, display, reproduce, and distribute your public content for the purpose of operating, promoting, and improving the Platform.
• License Granted to Other Users: You grant other Users a limited license to view your public content solely in connection with their use of the Platform.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAME GAME (AND STRATEDGE LABS) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF THE PLATFORM; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM; (C) ANY INTERACTION BETWEEN CLIENTS AND PROVIDERS. THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE".

11. Termination

We reserve the right to suspend or terminate your access to the Platform at any time, without notice and at our sole discretion, for any violation of these Terms or for any other reason deemed necessary to protect the integrity of the Platform.

12. Changes to Terms

We may revise these Terms from time to time. The most current version will always govern our relationship with you. If we make a material change, we will notify you via email or a platform notification. By continuing to use the Platform after those changes become effective, you agree to be bound by the revised Terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Stratedge Labs is established, without regard to its conflict of law provisions.

14. User Controls and Safety Tools

We provide tools to help you control your experience on the Platform:

• Report a Challenge: You may report any challenge you believe violates these Terms or our content guidelines. When reporting, you may be asked to provide details such as the challenge ID, challenge name, the relevant streamer page link, the creator username, and the current status at the time of the report. Our moderation team will review reports as soon as reasonably possible and may take appropriate action, which can include removal, restriction, or other measures.
• Block Another User: You may block specific users by username to prevent them from sending you new challenges. You can manage your blocked list at any time in your account settings. Blocking does not prevent users from viewing any of your public content.
• Delete Your Account: You may request deletion of your account from the settings page. Upon request, we will initiate deletion of your account and associated personal data within 24 hours, subject to legal obligations that may require retaining certain records. Account deletion is irreversible and will terminate your ability to log in or access past data. Limited information may persist in backups and logs for a reasonable period consistent with our Privacy Policy.
